Federal Adam Walsh (AWA) / Sex Offender Registration and Notification (SORNA) Act of 2006 – What States are SORNA Certified by SMART Office and Which Ones Aren’t?


The Federal Adam Walsh (AWA) / Sex Offender Registration and Notification (SORNA) Act of 2006 and certification of compliance by the Office of Sex Offender Sentencing, Monitoring, Apprehension, Registering and Tracking (SMART) in the 50 states.

Under multiple SORNA requirements it says, "The deviation does not substantially disserve the purposes of SORNA requirements". In other words, good enough Virginia.
 

Note-  Back on 05/03/2010 Delaware was certified as AWA/SORNA compliant by the SMART Office, making them the second State to be certified. As of February 2017 Delaware is no longer listed as AWA compliant.

From the above list of SORNA compliant states many of them (not Virginia) do these 8 things, so if Virginia did too, we would NOT lose SMART Office certification. I will continue to ask for legislation for these 8 goals. -Mary Devoy
  1. Removed the employer information from the online VSP Registry, goo.gl/g65RVk

  3. Stopped requiring misdemeanor offenses from registering as “Sex Offenders”
  4. Stopped requiring juveniles from registering as “Sex Offenders”, goo.gl/yDvWUX
  5. Removed misdemeanor offenses from the online VSP Registry and onto a private (authority only) list, goo.gl/DeeWOa
  6. Removed juveniles from the online VSP Registry and onto a private (authority only) list, goo.gl/yDvWUX
  7. Allowed juveniles to petition for removal on their 21st or 25th birthday instead of being “Lifers” on the VSP Registry, goo.gl/yDvWUX
  8. Eliminate Virginia’s myth-base Residency Restriction law, goo.gl/LMWgh7

I- The following states officially announced they will NOT take steps to become Federal Adam Walsh Act/SORNA compliant. 
  1. Arizona                 * Certain portions of their registry to achieve AWA compliance have been ruled unconstitutional
  2. California
  3. Colorado
  4. Minnesota
  5. New York
  6. North Carolina
  7. North Dakota
  8. Texas
  9. West Virginia
These states have researched their current registries and classification systems and determined AWA/SORNA is too broad, inferior to their systems, should not include juveniles and/or is NOT worth the high expense even with the threat of losing 10% of their Byrne Grant.

 
II- The following states haven’t officially announced they will not take steps to become Federal Adam Walsh Act/SORNA, but they’ve submitted no packages to the SMART office as of November 2012 for compliance review.
  1. Alaska

  5. Indiana               * Certain portions of their registry to achieve AWA compliance have been ruled unconstitutional

Out of 50 states, 19 of them have no interest in becoming AWA/SORNA certified.
